Terms of Use

These Terms of Use (“Terms”) govern your use of the Swipellio mobile application, website, and related features (“Swipellio” or the “App”).
Swipellio is provided by Evgenii Grunin (“Developer,” “we,” “us,” or “our”).
By downloading, purchasing, accessing, or using Swipellio, you agree to these Terms. If you do not agree, do not use the App.
1. Apple Standard EULA
The license to use the Swipellio iOS application is governed by Apple’s Standard Licensed Application End User License Agreement (“Apple Standard EULA”), unless a different agreement is presented through the App Store.

These Terms supplement the Apple Standard EULA and describe Swipellio’s functionality, subscriptions, user responsibilities, and additional conditions.
If these Terms conflict with the Apple Standard EULA regarding the license to the App, the Apple Standard EULA controls to the extent of that conflict.
2. What Swipellio Does
Swipellio is a photo-library review and cleanup utility.
The App may help you:
- review photos and videos;
- compare similar items;
- identify screenshots or other media categories;
- organize cleanup sessions;
- select items to keep or delete;
- estimate potential storage savings.
Swipellio provides tools and suggestions. It does not make final deletion decisions for you.
You remain solely responsible for reviewing selected items and deciding what to keep or delete.
3. Photo-Library Permission
Swipellio requires permission to access some or all of your photo library.
You decide whether to grant full or limited access through Apple’s permission system. Certain functionality may be unavailable or incomplete if access is denied, limited, or revoked.
You represent that you are authorized to access and manage the photos and videos available through the device and Apple Account you use with Swipellio.
4. Suggestions and Automated Results
Swipellio may use local algorithms, technical characteristics, similarity analysis, metadata, and other automated methods to organize or suggest photos and videos for review.
Automated results may be inaccurate, incomplete, duplicated, or inconsistent with your personal preferences.
Swipellio does not guarantee that:
- similar items are true duplicates;
- the best photo will be selected or recommended;
- every screenshot, duplicate, or unwanted item will be identified;
- an item suggested for deletion is unnecessary;
- an item not suggested for deletion is important;
- storage estimates will be exact;
- results will remain identical after an app or iOS update.
You must independently review every item before confirming deletion.
5. Deletion and Data-Loss Risk
Deleting photos or videos is an inherently destructive action.
Before deleting content, you are responsible for:
- carefully reviewing all selected items;
- confirming that important content is not selected;
- maintaining backups where appropriate;
- understanding how Apple Photos and iCloud Photos synchronize changes;
- checking the “Recently Deleted” album when recovery is required.
Deletion is performed using Apple’s Photos system and is subject to Apple’s system behavior, permissions, synchronization, and confirmation processes.
If iCloud Photos is enabled, deletions may synchronize across devices using the same Apple Account.
Content may become permanently unrecoverable after it is removed from “Recently Deleted,” after the recovery period expires, or as otherwise determined by Apple.
Swipellio does not operate a backup service, does not retain copies of your photo library, and cannot restore permanently deleted content.
6. Storage Estimates
Any displayed estimate of storage usage or potential storage savings is approximate.
Actual storage savings may differ because of:
- Apple Photos caching;
- optimized device storage;
- iCloud Photos;
- shared libraries;
- media formats;
- “Recently Deleted” retention;
- operating-system behavior;
- synchronization delays;
- other factors outside our control.
Deleting an item may not immediately produce the displayed amount of available device storage.
7. Free Features and Usage Limits
Swipellio may offer free functionality, limited access to certain modes, introductory usage allowances, promotional access, or paid features.
The availability and limits of free functionality may vary by App version, country, device, or App Store account.
We may change future free features and usage limits. Such changes will not remove rights that applicable law or Apple’s rules require us to preserve.
8. Paid Features
Swipellio may offer:
- auto-renewable subscriptions;
- non-consumable in-app purchases;
- promotional offers;
- other purchases permitted by Apple.
The exact product, billing period, price, included functionality, and availability shown in the App Store purchase interface at the time of purchase form part of your purchase terms.
Paid access applies only to the features described in the App and App Store at the time of purchase.
Features may evolve over time, but we will not intentionally deprive you of an active paid entitlement in violation of applicable law or Apple’s requirements.
9. Subscriptions
When you purchase an auto-renewable subscription:
- payment is charged to your Apple Account after you confirm the purchase;
- the subscription renews automatically unless you cancel it before renewal;
- Apple may charge your account for the next billing period according to Apple’s applicable billing rules;
- the renewal price is the price presented by Apple, subject to any required notice or consent;
- deleting Swipellio does not cancel the subscription.
You can manage or cancel subscriptions through your Apple Account subscription settings.
Cancellation stops future renewal but generally does not retroactively refund the current billing period. You normally retain access until the end of the paid period, subject to Apple’s rules.
Swipellio does not currently promise a free trial unless a trial is explicitly displayed and confirmed in Apple’s purchase interface.
10. Purchases, Billing, and Refunds
All in-app purchases are processed by Apple.
We do not directly process payment cards, debit bank accounts, or control Apple’s billing systems.
Purchase eligibility, regional availability, taxes, currency conversion, payment authorization, billing, family sharing, refunds, and charge disputes are handled according to Apple’s rules and applicable law.
Refund requests for App Store purchases must generally be submitted to Apple. Nothing in these Terms limits any refund or consumer right that applicable law provides and that cannot legally be excluded.
11. Restoring Purchases
Eligible purchases may be restored using the restore-purchases function in Swipellio or Apple’s systems.
Restoration may require the same Apple Account used for the original purchase and may depend on Apple’s transaction records and services.
We do not guarantee that a purchase associated with a different Apple Account, storefront, product, or platform can be restored.
12. Acceptable Use
You may use Swipellio only for lawful, personal purposes and in accordance with these Terms and the Apple Standard EULA.
You must not:
- interfere with the App’s normal operation or security;
- bypass payment, subscription, entitlement, or usage restrictions;
- use fraudulent purchase or refund methods;
- copy, modify, resell, rent, sublicense, or distribute the App except where law expressly permits;
- reverse engineer, decompile, or attempt to obtain the App’s source code except where law expressly permits;
- use automated methods to overload, probe, exploit, or disrupt the App;
- use Swipellio in a manner that violates another person’s rights or applicable law.
13. Ownership
Swipellio, including its software, interface, design, branding, graphics, text, and original functionality, is owned by or licensed to the Developer and is protected by applicable intellectual-property laws.
The App is licensed, not sold.
You retain all rights you already have in your photos and videos. These Terms do not transfer ownership of your photo-library content to us.

15. App Availability and Updates
We may release updates, corrections, compatibility changes, new features, or modifications to Swipellio.
We may also suspend or discontinue functionality where reasonably necessary because of:
- technical or security issues;
- changes to iOS, Photos, StoreKit, or other Apple services;
- legal or regulatory requirements;
- App Store decisions;
- misuse of the App;
- circumstances outside our reasonable control.
We do not guarantee that Swipellio will remain compatible with every device, operating-system version, photo format, region, or Apple service.
Where applicable law requires notice, continued access, a refund, or another remedy, we will comply with those requirements.

We do not guarantee a particular response time, resolution, or continued availability of support.
Do not send sensitive photos, videos, passwords, payment information, or other unnecessary confidential information in support requests.
17. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Swipellio is provided “as is” and “as available.”
We do not make warranties or guarantees that the App will:
- always be available;
- operate without interruption, delay, or error;
- identify every similar, duplicate, unwanted, or low-quality item;
- make correct recommendations;
- prevent accidental deletion;
- recover deleted content;
- free a specific amount of storage;
- work with every device, library, file, backup, or iOS version;
- meet every personal requirement or expectation.
To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and data preservation.
This section does not exclude warranties or consumer protections that cannot legally be excluded.
18. Limitation of Liability
To the maximum extent permitted by applicable law, the Developer will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to Swipellio.
This includes, where legally permitted:
- loss or permanent deletion of photos or videos;
- loss of memories or other personal content;
- loss of data or backups;
- unexpected iCloud synchronization;
- inaccurate grouping or recommendations;
- failure to free the expected amount of storage;
- device, operating-system, or App Store issues;
- loss of profits, revenue, opportunity, or goodwill.
To the maximum extent permitted by law, the Developer’s total aggregate liability relating to Swipellio will not exceed the greater of:
- the amount you paid for Swipellio during the twelve months immediately preceding the event giving rise to the claim; or
- USD 50 or its equivalent in local currency.
These limitations do not apply where liability cannot legally be excluded or limited, including where applicable law provides otherwise for fraud, intentional misconduct, gross negligence, death, personal injury, or mandatory consumer rights.
19. Your Responsibility
You accept responsibility for your own use of Swipellio and your own photo-deletion decisions.
You are responsible for maintaining appropriate device security and backups and for reviewing items before confirming destructive actions.
You should stop using the App and contact support if it behaves unexpectedly or appears to select items you did not intend to delete.
20. Suspension and Termination
You may stop using Swipellio at any time.
We may suspend or terminate access where reasonably necessary if:
- you materially violate these Terms;
- you attempt to bypass purchases or security controls;
- your use creates a legal, technical, or security risk;
- continued operation becomes unlawful or impractical;
- Apple removes or restricts the App.
Termination does not automatically cancel an Apple subscription. You must cancel subscriptions through your Apple Account.
Provisions that by their nature should survive termination will remain effective, including ownership, warranty disclaimers, liability limitations, and dispute-related provisions.
21. Changes to These Terms
We may update these Terms to reflect changes to Swipellio, subscriptions, Apple services, legal requirements, or our business.

The effective date will be updated when the Terms change materially.
Where applicable law requires notice or consent before a material change applies, we will provide it.
22. Applicable Law and Consumer Rights
These Terms are governed by the laws applicable to the Developer, without depriving you of mandatory consumer protections provided by the laws of the country or region where you live.
Nothing in these Terms restricts rights that cannot legally be waived or limited.
You may have the right to bring a claim before a court or consumer authority in your place of residence where mandatory law permits.
23. Severability
If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted, and the remaining provisions will remain in effect.
24. No Waiver
Failure to enforce a provision of these Terms does not waive the right to enforce it later.
25. Assignment
You may not transfer your rights or obligations under these Terms without our consent.
We may transfer these Terms as part of a merger, acquisition, restructuring, sale of assets, or transfer of the Swipellio business, subject to applicable law.
26. Entire Agreement
These Terms, the Privacy Policy, the Apple Standard EULA, and the purchase information presented by Apple form the agreement governing your use and purchase of Swipellio.
